FAQs Patent Questions

Question:How do I search for a particular patent number?

Answer:
There are several ways. The easiest is to use the Patent Number Search Page, enter the number you are searching for in the box provided, and hit the 'Search' Button. Alternatively, you can go to the Quick Search Page, select which year(s) you want to search by using the Select years to search menu, type the patent number in the Term 1 text entry box, and select 'Patent Number' from the Field 1 menu. Then hit the 'Search' button.

Question:What is a regulatory review period determination?

Answer:
The regulatory review period is the basis for patent extension. Basically, a regulatory review period is composed of two parts: a testing phase, and an approval phase. The testing phase for a human drug product is the period between the effective date of an investigational product exemption (Investigational New Drug Application) and the initial submission of the marketing application (New Drug Application).

Question:Use of inventions more than one year prior to filling a patent will prohibit the granting of a patent

Answer:
Inventors are also reminded that any public use or sale in the United States or publication of the invention anywhere in the world more than one year prior to the filing of a patent application on that invention will prohibit the granting of an U. S. patent on it.
